Digital Millennium Copyright Act Notice
Takedown Policy and Procedures
Locksley Shoemaker, owner of Gracie Jiu Jitsu Vista – Certified Training Center, holds a high regard for the intellectual property rights of others and expects the same respect from third parties. As per the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), copyright owners or their agents can submit a takedown notice to us through our DMCA Agent provided below. Being an internet service provider, we are eligible to seek immunity from such infringement claims as per the “safe harbor” provisions of the DMCA. For submission of a genuine infringement claim to us, it is essential to provide a notice encompassing the following details:
Notice of Infringement – Claim
- A physical or electronic signature of the copyright holder (or someone authorized to represent the owner);
- Identification of the copyrighted work that is claimed to be infringed;
- Identification of the infringing material that needs to be removed, including information sufficiently allowing the service provider to locate the material. [Please provide the URL of the specific page to assist us in identifying the purportedly offending work];
- Sufficient information permitting the service provider to contact the complainant, including name, physical address, email address, phone number, and fax number (if any);
- A declaration stating that the complainant genuinely believes that the material’s use is not authorized by the copyright agent;
- A statement confirming the accuracy of the information in the notification and, under the threat of perjury, confirming that the complainant has the authority to act on behalf of the copyright owner.
Title 17 USC §512(f) provides for civil damage penalties, inclusive of costs and attorney fees, against any individual who knowingly and substantially misrepresents particular information in a notification of infringement under 17 USC §512(c)(3).

Counter-Notification – Restoration of Material
In case you receive a notice regarding material takedown due to a copyright infringement claim, you may provide us with a counter-notification to have the material in question restored. This notification must be provided in writing to our DMCA Agent and should essentially contain the following elements as per 17 USC Section 512(g)(3):
- Your physical or electronic signature.
- A description of the material that was removed and its original location.
- A statement, under penalty of perjury, that you believe the material was removed or disabled due to a mistake or misidentification.
- Your name, address, and phone number, with a declaration that you agree to the jurisdiction of the federal district court for the district your address is located in (or, for those outside the U.S., any jurisdiction where the service provider can be located). Furthermore, an agreement that you will accept the process service from the original notifier of the infringement.

Repeat Infringer Policy
Gracie Jiu Jitsu Vista – Certified Training Center adopts a strict stance on copyright infringement. In accordance with the repeat infringer policy stipulations of the Digital Millennium Copyright Act, we maintain a record of DMCA notices received, with our registered DMCA Agent. We make a dedicated effort to recognize any repeat infringers in this list as per the DMCA’s safe harbor provisions.
Modifications
Gracie Jiu Jitsu Vista – Certified Training Center retains the right to modify the contents of this page and its approach for handling DMCA claims whenever deemed necessary. Regular reviews of this policy are recommended for updates.
